Many people believe a divorce settlement agreement is the paperwork they sign at the husband-wife marital dispute closing ceremony.

It is so much more.

I have handled thousands of divorce cases. And observed most divorce settlement problems arise because of careless drafting. Not because people don’t want to settle.

One spouse wants to “finalize quickly.” The other wants to “take care of things.” Documents are signed. Words are exchanged in the family court hallways.

After a few months, husband and wife are back fighting over something.

“Agar meri letter padhti hai toh tuition fee kyu nahi daali?” “Pay Da” “Case chal rahi hai kya?” “Ya hi de do parayi, tumhare bachche ki.” “Batti kyun giraye DADA.” Friends, family, ex-inlaws. Everybody has an opinion on your divorce settlement disagreement.

I get it. Most people just want to move on with their lives. And want to avoid conflict. That’s why they say yes to anything.

I hate to break this to you.

Indian divorce laws are NOT famous for enforcing unclear terms.

What divorce couples need is a carefully drafted divorce settlement agreement.

Divorce settlement agreement India is a written agreement between husband and wife.

The agreement records settlement terms on topics like:

  • Have both parties decided to dissolve marriage by mutual consent?

These details let family court know basic marriage information. They also record decisions taken by both parties about their matrimonial dispute.

ALIMONY TERMS IN DIVORCE SETTLEMENT AGREEMENT

Alimony and Maintenance Terms

  • Monthly or one-time settlement amount?
  • Will alimony/maintenance include expenses till date of agreement? (past)
  • Will agreement cover future monthly expenses?
  • Who will bear expenses of raising child, if any?

These questions become important when husband and wife agree on alimony/maintenance.

Courts will consider factors like husband’s earnings, wife’s earnings, lifestyle and marriage duration to decide one-time alimony.

Monthly alimony/maintenance may require husband to pay agreed upon amount every month. Courts have laid guidelines for monthly maintenance awards under Section 25 of Hindu Marriage Act. Some of them are:

  • Actual income of parties
  • Needs of parties
  • Payments should not plunge husband to penury
  • Status, obligations, conduct of parties
  • Duration of marriage
  • General health and earning capacity of parties
  • Age of parties
  • Nature of lifestyle enjoyed by wife
  • No alimony is awarded if wife is remarried or living in adultery

Percentage of husband’s salary to be awarded as maintenance to wife is NOT FIXED by courts in India. Every case is judged on its facts.

If wife is working, her job profile and income potential may be considered.

Courts focus on “child’s welfare paramountment” when parents cannot decide.

While all custody terms should be clear, I specially want to point out visitation details.

Visitation details are not ”Father wants to meet son”. Visitation should detail time and mode of access.

Some common visitation clauses which I have personally used are:

  • Women and babies beco court children every Diwali and Holi
  • Family members can meet child anytime with consent from parent having physical custody
  • Similar funny yet serious clauses can be used.

Property documents/notices must be attached before agreement is signed.

Don’t ever leave large assets like property ambiguously mentioned in agreements.

Transfer and registration fees are high. Don’t let your ex take advantage by hiding intentions.

Each stridhan item mentioned by wife should ideally be mentioned in agreement.

If not feasible, make a STRIDHAN SETTLEMENT LETTER agreement where each item is listed. Get wife to sign acknowledgements when she takes back items. Don’t ever leave stridhan terms oral.

DEFAULT CLAUSE

Be practical. Things happen. Husband can lose job. Wife can fall sick.

Life is unpredictable.

Because of this, you should always ask yourself

  • If something goes wrong, whose fault is it?

Ideally divorce agreements should have a default clause. A default clause basically tells you what happens if:

  • One party does not turn up for second motion?
  • Payment from husband is delayed?
  • Cases are not dropped?

Agreements should address likely disputes.

Doing so can prevent future litigation.

A good agreement is not to harass your partner. It is to PREVENT harassment by your EX-parnter.

1. What is divorce settlement agreement?

Divorce settlement agreement India is agreement between husband and wife. They record terms on which they agree to resolve their matrimonial dispute. Such terms can relate to alimony/maintenance, child custody/visitation, property, stridhan return, pending filings/cases and mutual consent divorce terms.

2. Do I really need a divorce settlement agreement if we both consent for divorce?

Yes. Divorce by mutual consent means you both agree to “mutually settle” your differences in court. If you have no differences, you can apply for a joint divorce without appearing in family court. Learn more about joint divorce without tracing wife in India.

Mutual consent divorce has two motions. First motion and second motion.

During first motion, both parties confirm they have decided to divorce and settled their claims.

During second motion, parties confirm that they have not had a change of heart and request divorce decree from court.

This means you both need to appear in family court atleast twice before a judge. If you settle claims privately without a written agreement, disputes may arise later about what you had agreed.

Again, divorce settlement does NOT need to be complicated. Don’t go overboard. Start with the main terms required in every divorce agreement. Then go ahead and customize it to suit your situation.

3. Can divorce settlement agreement be written on plain paper?

Yes. There is no special format for divorce agreements in India. Lawyers often use presentation folders or word document to draft agreements.

Just make sure it covers all terms, can be understood by both parties and is legally verified(optional) before signing.

4. Is divorce settlement agreement legally valid?

When signed by husband and wife under their free will, divorce agreements can be shown to courts as proof of mutual decisions taken by parties about their disputes.

Copies can be placed in your mutual consent divorce documents album (album-3). Family courts often advise couples to settle their claims before first motion.

If issues like stridhan/jewellery, property or loans are involved, parties may also send divorce settlement agreement to bank for updating loan documents/life partners.

Again, courts do NOT enforce oral agreements based on one party’s say-so. If proof of divorce agreement is required, it should be properly documented.

5. Do I need to be lawyer for divorce settlement agreement?

I know lots of husbands and wives draft their own divorce agreements. Heck. I started my career drafting divorce settlement agreements.

But…

Careful is different from cautious.

Just because you can draft divorce settlement agreement doesn’t mean you should do it yourself.

Crossing Ts and dotting Is are important in Indian legal documents. An amateur mistake can cost you dearly in future litigation. If you aren’t comfortable with the laws discussed in this article, seek help.

6. Should I notarize divorce settlement agreement?

Notarization does TWO things:

Shows who executed the document

Ensures both parties agreed under free will

It does NOT make your divorce settlement agreement legally binding. Only a judge can do that.

Also, most divorces are settled outside courts FIRST. Only when agreement is ready do parties take it to court for confirmation.

7. Does divorce settlement agreement need to be registered?

Divorce settlement agreements do not need to be filed/registered with the government of India.

Registration adds legal value to your document. Again, its completely upto you if you want to register agreement or not.

8. Can we settle property in divorce agreement?

Yes. You and your husband can agree to transfer property/flat titles to one party. Or both of you can agree to jointly sell the property and share proceeds.

If property is held jointly by you and your husband, parties can mention who will bear loan obligations till property is sold.

For jointly owned property, agreement can mention terms like:

Who will transfer share?

Will property be sold instead?

If sold, how will proceeds be divided?

Who will bear loan obligations till sale?

Who will transfer/deed documents?

Does wife have any share in house property currently in husbands name only? Husband agrees to

Note how each question clearly asks what parties want to decide.

Don’t leave property terms vague in your divorce settlement agreement.

9. Can wife side expenses be put in divorce settlement?

If husband and wife agree, any expenses can be mentioned in divorce settlement agreement.

But remember, agreement is binding. Decide expenses wisely. Don’t agree to pay unreasonable expenses in divorce. Think about tax implications too.
